Client service agreement for The Empress Circle

The Empress Circle
A Coaching Program by The Witch’s Bedroom LLC

This Client Service Agreement is entered into as of 6/4/2025, by The Witch’s Bedroom, a company organized under the laws of North Carolina, USA. Facilitated by Shannon M Hale, aka Zelda Bell and Ceilidh E Zokaitis Hill aka Wysteria Root (“Facilitators”), and engaging The Empress Circle participant ("Client").

1. Services Provided

The Facilitators agree to provide the following services over a period of 3 consecutive months:

- Weekly 90 minute group coaching sessions via Kajabi, and 60 minute mentor office hours every other week
- One private intuitive reading with Wysteria
- One private intuitive reading with Zelda
- Access to 13 weeks of course curriculum, rituals, bonus materials, and live digital events

All program elements are delivered virtually through Kajabi. Live components may be recorded and/or subject to schedule adjustments. Programs may also include sessions with guest teachers and community-led practice. Program content may be added, removed, or rearranged at the Facilitators’ discretion. 

2. Fees & Payment Terms

The total program fee is $1665.00 USD, payable by payment plan: 3 monthly installments of $555.00

Client authorizes recurring charges via their chosen payment method. Missed or failed payments will result in a 3-day grace period, after which access to program materials may be suspended until the account is brought current.
No refunds will be issued for any reason, including but not limited to non-participation, schedule conflicts, or dissatisfaction with program outcomes.

3. Confidentiality & Participation

Client agrees to maintain the confidentiality of all members and content shared within the program, including but not limited to personal stories, rituals, group discussions, and proprietary materials.

Client also agrees to:
- Participate with integrity and punctuality
- Honor the energetic and emotional safety of the group
- Seek professional care for mental and physical health concerns beyond our scope of practice
- Refrain from harming others, disrupting group space, or engaging in harassment
- Engage in all discussions with mutual respect and clear consent.

4. Trauma-Informed Disclaimer & Waiver

Facilitators provide services in a trauma-informed capacity but are not licensed therapists, psychologists, or healthcare providers. Coaching does not substitute for mental health treatment.

By signing this Agreement, Client:
- Acknowledges that coaching is not medical or psychological care 
- Agrees to take full responsibility for their emotional and physical well-being 
- Releases Facilitators from any and all liability for mental or physical health outcomes, and other consequences of Client exercising their free will. 

5. Termination

Facilitators reserve the right to terminate this Agreement and revoke Client’s access to the program with immediate effect and without refund if:

- Client violates any material term of this Agreement
- Client causes harm, disruption, or undermines the safety of the space
- Client’s behavior constitutes harassment, abuse, or infringement of Facilitators’ intellectual property
- Client’s needs or conduct fall outside the ethical or professional scope of the program

Facilitators may terminate participation at their sole discretion, for any reason they deem in misalignment with the spirit and intention of the container.

6. Intellectual Property

All content, including but not limited to videos, readings, rituals, PDFs, and digital assets, are proprietary to The Witch’s Bedroom LLC and protected under U.S. copyright law.

Client may not:
- Copy, distribute, sell, or publicly display any materials 
- Repurpose program content for commercial or teaching use 
- Record sessions without explicit written consent

Violation of this clause may result in legal action and immediate termination of access.

7. Media Release

Client agrees that any recordings, written responses, testimonials, or participation in live sessions may be used by Facilitators for educational or promotional purposes, unless Client provides written notice requesting anonymity.
Facilitators will make reasonable efforts to honor privacy requests.

8. Limitation of Liability

To the fullest extent permitted by law, Facilitators disclaim all warranties, express or implied, and shall not be liable for any indirect, incidental, or consequential damages arising from participation in the program.
In no event shall Facilitators’ liability exceed the amount paid by the Client for the program.

9. Indemnification

Client agrees to indemnify and hold harmless Facilitators, The Witch’s Bedroom LLC employees, contractors, and affiliates from and against all claims, damages, or liabilities arising out of Client’s participation in the program, breach of this Agreement, or misuse of program materials.

10. Dispute Resolution & Governing Law

This Agreement shall be governed by and construed in accordance with the laws of North Carolina, USA. Both parties agree to attempt to resolve disputes through informal discussion and mediation before pursuing litigation.
Any legal claims arising from this Agreement must be filed exclusively in a court of competent jurisdiction in North Carolina.

11. Entire Agreement

This Agreement constitutes the full understanding between the parties. No verbal or other written agreements shall modify it unless signed by both parties.

12. Content Policy – Nudity and Explicit Material

This is a sacred, sensual, and trauma-informed container where topics such as embodiment, sexuality, and self-pleasure may be discussed. While nudity and erotic self-expression may be referenced in teachings, clients are strictly prohibited from uploading, posting, or sharing explicit content in any form — including but not limited to:

- Images or videos containing nudity or sexually explicit acts 
- Self-made pornographic material, links to external porn, or graphic sexual depictions
- Erotic content shared in a non-consensual, disruptive, or triggering manner

Clients are encouraged to share personal experiences and reflections within consensual boundaries. Any submission of inappropriate or explicit media will result in immediate removal from the program without refund. All client interactions must be rooted in mutual respect, clear consent, and shared responsibility for the emotional wellbeing of the space.

13. Consensual Participation

By participating in The Empress Circle, the Client affirms that they have read, understood, and consent to be legally bound by this Agreement.
